Administrative law

Permissions, licences and protection against official interference: I represent businesses and individuals before authorities and courts.

Public building law

I assist with building applications and changes of use and assess entitlement to permission, including planning compliance, building regulations and conflicts with neighbouring properties.

For use prohibitions and demolition orders, I develop a strategy tailored to the decision. I examine existing permissions, protected existing use, potential legalisation and proportionality. Urgent situations may also require interim relief.

Business licensing and hospitality law

I help obtain business licences and challenge burdensome conditions, revocations and prohibitions. For hospitality businesses, I also consider operating hours, outdoor seating and lawful use of the premises.

Regulatory offences and excessive rents

Fines relating to property letting or use can seriously affect a business. I assess the allegation and evidence, inspect the file and assist with submissions and, if needed, objection proceedings.

Excessive rent under section 5 WiStG is a regulatory offence. Criminal rent usury under section 291 StGB has separate requirements. Following an objection, fine proceedings generally go to the local court, not the administrative court.

Applications and administrative proceedings

Legal assistance can help before a decision is made. I examine the objective, requirements and documents and assist with legal grounds for applications, hearings and communication with the competent authority.

The matter may concern permission, a licence, an exception, official consent or opposing a proposed measure. I identify the procedure and explain the available options.

Administrative decisions, conditions and prohibitions

A burdensome decision can have serious personal or financial effects. I assess its legal basis, procedure and reasoning, including use prohibitions, conditions, refusals and withdrawal or revocation of licences.

The assessment also identifies which parts can be challenged and the prescribed procedural route.

Objections, court proceedings and interim relief

The appropriate remedy depends on the area of law and the decision. I assess objections or court proceedings and provide representation, including interim relief where urgent.

Administrative litigation offers different procedures. The suitable application and its requirements can only be assessed in the particular case.

Residential use restrictions and other administrative matters

I advise on Berlin’s residential use restrictions, housing use and official interventions. Enquiries about other administrative matters are also welcome; the specific issue and legal connections determine the approach.
