Understanding the allegation before responding
Accused persons may remain silent and seek legal advice. I clarify their procedural position, dates and immediate steps. After file access, we discuss whether and how to respond.
Defence also means identifying exculpatory facts and evidence early. I assess the legal position and develop a strategy reflecting the evidence and procedural stage.
Investigations and court proceedings
In accepted cases, I represent clients before investigators and courts, explain options and consequences, and assess different ways to conclude proceedings as appropriate.
Penalty orders and court papers require prompt review of service and deadlines. Contacting a firm alone does not preserve a deadline. If another specialisation is needed, I can help find a suitable colleague on request.
Practical examples
These examples describe typical situations. The appropriate response depends on the facts of each case.
Documents for the initial assessment
Have the summons, decision or penalty order, envelope and service date ready, along with the file number, previous statements and imminent dates. Further documents are requested after initial discussion.
Frequently asked questions
Must I immediately answer questions about the allegation?
You may remain silent and consult defence counsel. Whether you must nevertheless attend a hearing depends particularly on which authority issued the summons.
